On June 7, 2023, the academic staff and students of KNUTD took part in the round table "34 Poles of Creativity: Protection of Intellectual Property in the Fashion Industry", organized by the State Organization Ukrainian National Office of Intellectual Property and Innovations.
The round table was attended by postgraduate students, bachelor's and master's degree students of the Departments of Art and Fashion Design (the Faculty of Design), Modeling and Artistic Decoration of Clothes, Fashion and Clothing, Fashion Technologies, Professional Education in Technologies and Design (the Faculty of Arts and Fashion), Vice-Rector for Research and Innovation Liudmyla Hanushchak-Yefimenko, Head of the International Institute of Postgraduate and Doctoral Studies Svitlana Arabuli, scientific and pedagogical workers – Kalyna Pashkevych, Nataliia Pervaya, Nataliia Ostapenko, Maria Bilianska, Olena Kolosnichenko, Nataliia Chuprina, Olha Yezhova, Tetyana Struminska, Olena Gerasymenko, Petro Harkin, and others.
The event was moderated by Dmytro Doroshenko, Head of the Department of Development of Creative Sectors of the Economy at the Ukrainian National Office of Intellectual Property and Innovations.
At the beginning of the round table, Olena Orliuk, Head of the Ukrainian National Office of Intellectual Property and Innovations, made a welcome speech, emphasizing the importance of developing the sphere of intellectual property protection.
At the round table, the issues of creative work protection in the field of creative industries and the fashion industry were highlighted. The purpose of the event was to spread information about the justified choice of protective documents for fashion industry products as objects of intellectual property, their patent support, protection in Ukraine, and ways of commercialization.
Olena Osmolovska made a report on the conditions for providing legal protection to intellectual property objects, the subjects of industrial design rights, their rights, the criteria for the protection of an industrial design in the fashion industry, and spoke about the objects that should be registered and those that do not require registration. The speaker emphasized that the condition of patentability of an industrial design is its novelty and individual character.
Yuliana Zukh deepened the information of the previous speaker, focusing the attention of the event participants on the package of documents containing the application for the industrial design certificate, the duration of registration, the validity period, the cost of fees for the patent procedure, etc. The speaker also familiarized the audience with the advantages provided by intellectual property in the conditions of a market economy and gave as examples statistical data on the increase in the number of registrations of industrial designs by well-known brands in EU countries.
Dmytro Doroshenko spoke on the protection of rights to industrial designs – clothes, shoes, and other goods of the fashion industry, and emphasized that an industrial design can receive legal protection both after registration and by bringing it to the public (for example, through demonstration at an exhibition, in the catalog, etc.). The moderator disclosed the features and grounds for protecting the rights of intellectual property objects on Internet platforms, even at the stage of the existence of a real threat before committing a violation. The speaker gave examples of the legal protection of intellectual property rights by well-known companies and not only.
Maksym Popov (Mentors Law Firm) made a report on the protection of intellectual property in the fashion industry. Using concrete examples, he showed precedents in the fashion industry when compensations were collected for copyright infringement both at the level of global fashion houses and brands, as well as Ukrainian designers and brands, he cited examples of violations of the rights of holders of valid protection documents and applicants for industrial property rights.
In his report, Maksym Popov also focused on ways to protect trademarks of manufacturers of clothing, footwear, and fashion industry goods, and shared his experience on how to protect one’s brand and not harm its reputation.
Leonid Tarasenko talked about the protection of corporate style, brand identity, and the company.
The report on "Support and promotion of TISC: new global challenges, opportunities and prospects" was made by Anastasia Yarmoliuk, Head of the Department of Development of the Network of Technologies and Innovation Support Centers of the IP Office.
