THE PROCEDURE FOR TRANSFER, EXPULSION, AND RE-ENROLLMENT OF STUDENTS IN HIGHER EDUCATION INSTITUTIONS

The procedure for transfer, expulsion, and re-enrollment of students in higher education institutions is carried out in accordance with the Order of the Ministry of Education and Science of 15.07.1996 No. 245 “On Approval of the Regulation on the Procedure for Transfer, Expulsion and Re-enrollment of Students of Higher Education Institutions” https://zakon.rada.gov.ua/laws/show/z0427-96#Text

 

General Provisions

These Provisions regulate the transfer of students studying for the junior specialist and bachelor’s degree, as well as the expulsion and re-enrollment of students studying for the junior specialist, bachelor, specialist, and master’s degree in higher education institutions regardless of their subordination and form of ownership.

Transfer of students studying for specialist and master’s degrees from one specialty to another is not allowed.

The rectors of higher education institutions have the right to consider, as an exception, the issue of transferring students studying at the specialist and master’s levels from one higher education institution to another, or from one form of study to another, only if they are transferred to the same specialties in which they were trained.

 

Transfer of Students

1. The transfer of students from one higher education institution to another, regardless of the form of study, field of study, or specialty, is carried out with the consent of the rectors (directors) of both higher education institutions.

2. The rector (director) of a higher education institution shall transfer students from one field of study to another, from the specialty in which junior specialists are trained to another, or from one form of study to another within the higher education institution.

3. The transfer of students, as well as the re-enrollment of persons who have been expelled from higher education institutions, is usually carried out during the summer or winter holidays.

4. Persons who have entered higher education institutions and studied at the expense of the state budget have a priority right to transfer and re-enrollment to state-funded places, provided that such vacancies are available.

In the absence of vacant places financed from the state budget, the above-mentioned persons, with their consent, may be transferred or re-enrolled for training with payment from the local budget, sectoral ministries, departments, enterprises, organizations, institutions, and individuals, provided that there are vacant places of the licensed volume.

5. Persons studying at a state higher education institution on a contractual basis with payment at the expense of the local budget, sectoral ministries, departments, enterprises, organizations, institutions, and individuals may be transferred to study on the same terms to other state higher education institutions.  Such transfers may be made subject to the availability of vacant places of the licensed volume and the consent of the customers financing the training.

The aforementioned persons may also be transferred to vacant places of state order in this or other higher education institution on a competitive basis and subject to the consent of the customers.

6. Persons studying at an accredited non-state higher education institution may be transferred to state higher education institutions under the conditions provided for persons studying at a state higher education institution on a contractual basis (Сlause 5)

7. Students studying at unaccredited non-state higher education institutions do not enjoy the right to transfer to state higher education institutions.

8. If there are bilateral agreements (student and enterprise, organization, institution) or trilateral agreements (student, educational institution and enterprise, organization, institution), the transfer of students from one field of higher education to another, from one specialty, form to another, or from one higher education institution to another is subject to appropriate amendments to these agreements, in compliance with the requirements of the current legislation.

9. Transfer of students to the first year of higher education is prohibited.  Under exceptional circumstances, these issues may be considered by ministries or departments that have higher education institutions under their jurisdiction.

10. A student who wishes to transfer to another higher education institution shall submit an application for transfer to the rector (director) of the higher education institution where he/she is studying and, having received his/her written consent, shall submit this application to the rector (director) of the higher education institution to which he/she wishes to transfer.

11. If the application is considered positively and the academic difference is eliminated, the rector (director) of the higher education institution issues an order allowing the student to attend classes and sends a request to the educational institution where he or she previously studied to receive his or her personal file by mail.

12. The rector (director) of the higher education institution where the student previously studied, upon receipt of the request, issues an order to expel the student in connection with his/her transfer to another higher education institution and sends the student’s personal file to the address of the higher education institution from which the request was received within one week.  The higher education institution where the student previously studied shall retain copies of the academic transcript, student record card, academic record book, and the list of documents sent.  The procedure for storing these documents is the same as for personal files of students.

13. The rector (director) of the higher education institution to which the student is transferred issues an order on his/her enrollment after receiving the personal file.

 

Expulsion of Students

14. A student may be expelled from a higher education institution:

- at his request;

- due to transfer to another higher education institution;

- for health reasons based on the opinion of the medical advisory committee;

- for academic failure.

15. The expulsion of underage students is carried out in agreement with the service for minors of local executive authorities.

 

Re-enrollment of Students

16. Re-enrollment of students is carried out by the rector (director) of a higher education institution regardless of the duration of the break in studies, the reason for expulsion, length of service, form of study, and taking into account the applicant’s ability to complete the educational process.

17. Students who have studied at unaccredited non-state higher education institutions do not enjoy the right to be re-enrolled to state higher education institutions.

18. Persons expelled from higher education institutions of III and IV accreditation levels may be re-enrolled to study at higher education institutions of I and II accreditation levels.

19. The application for transfer or re-enrollment must be considered by the higher education institution within two weeks, and the applicant must be informed of the conditions of enrollment or the reason for refusal.

20. The procedure for eliminating academic differences is established by the rector (director) of a higher education institution. As a rule, academic differences are eliminated before the start of classes.

21. The re-enrollment of students to the first year of higher education is prohibited.  The rector (director) of a higher education institution has the right to re-enroll students who have been expelled from the first year of study, provided that they have eliminated their academic debt before the start of classes.

 

Paperwork and Registration

22. A student who is expelled from a higher education institution is issued an academic transcript of the established form approved by the Resolution of the Cabinet of Ministers of Ukraine of 17.12.93 No. 1058 (1058-93-п) “On Approval of the List and Samples of Documents on Education and Academic Titles in Ukraine”, and the original document on complete general secondary (basic general secondary) education.  The student’s file includes a copy of the academic transcript signed by the management of the higher education institution and sealed with the stamp, a student’s record book certified by the dean (head of the department), a student card, and a student’s academic record card signed by the dean (head of the department) with the seal indicating that the student has completed the curriculum.

23. Information about the subjects studied, the tests, and the exams passed is entered into the academic transcript separately for each semester.

24. When filling out an academic transcript for students who have studied without disrupting their employment, the number of hours provided for in the curriculum for full-time study should be entered in the “Number of hours in the curriculum” column.

25. A student who has studied at several higher education institutions shall be issued an academic transcript, which includes the grades obtained during his/her studies at these institutions.  In this case, before the list of subjects taken at the higher education institution issuing the transcript, the subjects taken at other higher education institutions shall be entered in the academic transcript and the names of these institutions shall be indicated.

26. The academic transcript does not include subjects in which the student received unsatisfactory grades. Students who have dropped out from the first year of higher education and have not taken exams and tests are issued an academic transcript stating that the student has not taken tests and exams.

27. A student who has been re-enrolled in a higher education institution is issued a record book with the re-calculated grades obtained in another educational institution. The dean of the faculty (head of the department) is responsible for re-registration of the courses.

28. The personal file of a student (transferred from another higher education institution or re-enrolled) includes an extract from the order of admission, an application, and an academic transcript.

29. Registration of academic transcripts is carried out in a special book, where the following data are entered:

- serial number of the registration;

- surname, name, patronymic of the person who received the academic transcript;

- academic transcript number;

- date of issue;

- signature of the person who received the transcript;

- grounds for issuing an academic transcript.
