SESSION OF SCIENTIFIC CIRCLE ACTUAL ISSUES OF PRIVATE LAW

On October 21, 2024, a meeting of the scientific group «Actual issues of private law» was held (the head of the scientific group is O.M. Koval). Topic: «Electronic evidence in court proceedings: opportunities and challenges».

At the beginning of the meeting, the head of the group, associate professor O.M. Koval, drew attention to the importance of introducing electronic evidence into modern court practice. She also noted that in the conditions of digital transformation of society, more and more evidence exists in electronic form. The use of electronic evidence opens up new opportunities for increasing the efficiency of judicial proceedings, but at the same time, a number of challenges arise related to the verification of the authenticity of such evidence, their legal status and the protection of the rights of the parties in the process.

The participants of the meeting considered the actual issues of legal regulation of electronic evidence in the criminal process, discussed the problems of recognizing them as admissible and authentic, and also studied the international experience in this field. Important attention was paid to issues of cyber security and protection of personal data in the context of the use of digital evidence.

Students of higher education who participated in the meeting had the opportunity to familiarize themselves with scientific publications that reveal the legal aspects of working with electronic evidence, and came to the conclusion that the regulatory regulation of this area in Ukraine needs further improvement. In particular, it was emphasized the importance of creating specialized procedures for storing and processing electronic evidence, which will increase their reliability and admissibility in court proceedings.

The meeting ended with an active discussion of the prospects for the development of legislation in the field of electronic evidence, which will contribute to increasing the level of justice in Ukraine.
